The United States is one of the largest destinations for Indian basmati globally, split between South Asian grocery chains, foodservice distribution, and a growing private-label retail segment. If you’re importing into the US for the first time, here’s the compliance picture.
FDA Prior Notice
Before any food shipment arrives in the US, the FDA requires advance electronic Prior Notice — filed by the importer or their customs broker — identifying the shipment, its origin and its expected arrival. This isn’t optional paperwork; a shipment without valid Prior Notice can be held or refused entry at the port.
Foreign Supplier Verification Program (FSVP)
Under the FDA Food Safety Modernization Act, the US importer of record is responsible for verifying that their foreign supplier — in this case, us — meets US food safety standards. This is the importer’s obligation, but as your supplier we provide the documentation your FSVP file needs: facility information, relevant certifications, and product specifications. If this is your first FSVP-covered import, it’s worth engaging a consultant familiar with FSMA requirements rather than assembling the file from scratch.
Customs entry
Rice is classified under HS heading 1006 for US customs purposes. A licensed US customs broker typically handles formal entry, duty calculation, and coordination if FDA flags the shipment for review at the port of arrival. Most experienced importers have an existing broker relationship; if you don’t, your freight forwarder can usually recommend one.
Retail labelling
Rice sold at retail in the US needs a US-format Nutrition Facts panel, net weight declared in both metric and US customary units, and clear ingredient and country-of-origin declarations. For private-label programmes, we work to your label specification — just confirm your label proof against current FDA labelling requirements before finalising print, since requirements are updated periodically.
A practical first-order checklist
- Confirm your FSVP is in place, or engage a consultant if this is your first FSMA-covered import.
- Arrange a customs broker for HS 1006 entry and Prior Notice filing.
- Agree Incoterms and payment structure with your supplier.
- If retail-bound, finalise your Nutrition Facts panel and bilingual/metric labelling before print.
- Confirm your target port — commonly a US East or Gulf Coast port for India-origin cargo — with your freight forwarder.
